The EU Data Act, which took effect in September, promotes broad data sharing in the name of innovation and competition, and expands the rights for both businesses and consumers to access, use and share information generated by connected or “smart” devices. The Act also requires cloud service providers to make it easier for customers to change providers and take their data with them, setting up tension with requirements under the EU GDPR, which prioritises the protection of personal data, to ensure a lawful basis for such sharing and the data minimization principle.
