The array of IP and common law rights to data and information that may be claimed by third parties when information, data and content is used to train algorithms is an area sometimes overlooked or misunderstood by privacy professionals. The laws governing copyright, trespass, conversion, common law privacy, the CDA, the CFAA and anti-circumvention provisions under federal and state law create potential liability for companies based on what is taken, how it is accessed and what is done with it. This program will highlight existing laws, trends, ongoing litigation and best practices. It will also take a deep dive into privacy compliance from an in-house perspective, focusing on best practices that companies should employ. The program will also touch on using AI in your legal and privacy practices.
