Data brokerage is entering a new era, driven by rapidly evolving regulations and surging demand for data to fuel AI. Expansive state registration laws, new restrictions on data sales and transfers, and broader definitions of data brokerage are sweeping a wider range of businesses into the regulatory spotlight. At the same time, demand for data to develop and train AI systems is creating new incentives for companies to monetize existing datasets—and for new businesses to build products specifically to collect and sell data to AI developers. This panel will examine how the convergence of AI, data monetization, and evolving data broker laws and restrictions on data transfers is reshaping the legal and enforcement landscape. Panelists will discuss emerging state requirements, the practical implications of broader definitions of data brokerage (including under the DOJ’s Data Security Program Rule), and the compliance questions companies should address before acquiring, licensing, or commercializing data. The session will offer practical perspectives on identifying when an organization may be treated as a data broker and managing the privacy, regulatory, and commercial risks of data transactions in the AI economy.
