With a new majority formed when Alvaro Bedoya was confirmed by the Senate on May 11, 2022, the Federal Trade Commission is now able to implement one of its most ambitious agendas in over a generation. Its industry focus includes technology companies, digital platforms, and healthcare businesses. Its subject matter areas of focus include “lax security practices,” “surveillance advertising,” bias associated with algorithmic decision making and the use of biometrics, and “dark patterns,” (deceptive and manipulative conduct on the Internet). This session will explore how the Federal Trade Commission is implementing these industry and subject matter areas of focus in rulemakings under the Magnuson-Moss Warranty Federal Trade Commission Improvements Act and in enforcement actions.
