The Standard Contractual Clauses for data transfers adopted by the European Commission in June 2021 brought much-needed clarity for businesses that transfer personal data across international borders. However, the new SCCs do not apply in all situations, as they have not been adopted for data transfers from the UK. Further, recent EDPB guidance confirms that the new SCCs are not appropriate for transfers of personal data from controllers that are subject to the GDPR by virtue of its extra-territorial reach. This session will consider the latest developments concerning data transfers, focusing on the potential pitfalls.
