The Supreme Court’s 2022 majority decision in Dobbs v. Jackson Women’s Health rejected the principle that the constitutional right to privacy encompasses an individual’s right to abortion. Post-Dobbs, privacy rights regarding reproductive health information are in limbo. In April 2023, the U.S. Department of Health and Human Services issued proposed amendments to the HIPAA Privacy Rule that would help clarify those rights. At this session, attendees will learn about the key elements of the HHS proposed amendments and their potential impact on a range of stakeholders, and will be engaged by the panelists in a broader discussion of related privacy issues and concerns.
